Five or More Employees


California’s Fair Employment and Housing Act
California employers with five or more employees may not discriminate on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status or sex. Further, California employers of five or more employees may not discriminate against employees based on actual or perceived sexual orientation. Federal anti-discrimination laws have a minimum threshold of 15 employees, but California’s Fair Employment and Housing Act takes precedence where it is more stringent on an employer.
